If conservatives are so concerned about states’ rights, why didn’t they protest when the Bush administration refused to respect laws legalizing medicinal marijuana in several states? For that matter, why didn’t they protest when the United States Supreme Court put Bush in office, ignoring matters such as decisions of the Florida Supreme Court and the will of the voters?

    Because they are hypocrites. 

    In 2000 the Supremes should have tossed the question back to Florida.  The likeliest outcome would have been that the Florida legislature would have picked the delegates to the Electoral College.  Same outcome as what happened, but in accordance with constitutional procedure.

    The ideal situation (which might have never occurred as it is different from what Gore was seeking at the time) would have been a state wide recount. That would have given a different outcome.

    Maybe.  But that could not have been arranged within the Constitutional requirements for the meeting of the Electoral College.  Consider that they are still counting in Minnesota.

    Recounts were well under way in parts of the state. With enough of an effort perhaps it could have been done in time. I wonder if counting in the Minnesota Senate race would be taking so long if they had a tight deadline they were forced to operate under.

    They could have also done something such as submit two slates of electors with the House to make the final decision based upon the recount. This would have given them significantly more time to complete a deadline–but they still would have had to be much faster than Minnesota.
